NO PURCHASE, PAYMENT OR ENTRY FEE IS NECESSARY TO ENTER OR WIN. A PURCHASE, PAYMENT OR ENTRY FEE OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
Agreement
1. Eligibility
The Pax8 Beyond 2024 Giveaway (the “Giveaway”) is open only to legal residents of the United States, where not prohibited, who are over 18 years of age and who attend submit a survey response (“Survey”) from the Beyond 2023 Event. The Giveaway is subject to all applicable federal, state and local laws and regulations and is void where prohibited by law. Participation constitutes an Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing
The Giveaway begins on June 14, 2023 and ends on June 17, 2023. There is a three-day (72-hour) entry window, from Pax8’s send of the Beyond 2023 Day 2 Recap email on June 14, 2023 at approximately 10:00a.m. Mountain Savings Time to June 17, 2023 at 10:00a.m. Mountain Savings Time. Administrator’s computer is the official time-keeping device of the Giveaway. Pax8 reserves the right to send the email at a different date and time, but within the 24 hours following the stated window.

5. How to enter:
Eligible entrants (“Entrant(s)”) may participate in the Giveaway by completing the survey that is linked from the Beyond 2023 Day 2 recap email and following instructions to enter the Giveaway by completing the Survey. Submission of the Survey will be a complete entry.
All entries must be submitted no later than 9:59:am Mountain Savings Time by the Entry Deadline (June 17, 2023), or within 72-hours of Pax8’s Beyond 2023 Day 2 Recap email, whichever is sooner. MESSAGE AND DATA RATES APPLY FOR ENTRY. Submitting the requested information during an Entry Period constitutes an Entrant’s full and unconditional agreement to these Official Rules. In the event of a dispute as to any entry, the authorized account holder of the email address listed in the Assessment will be deemed to be the Entrant. Limit one (1) entry per person/per Event and limit one (1) prize per Entrant’s employer/per Event. An entry will be void and disqualified if such entry (i) is generated by any means inconsistent with the terms of these Official Rules, (ii) contravenes the spirit of the entry process described herein, including entries generated by script, macro or other automated means, (iii) contains any inappropriate material or language, including profanity. Sponsor and Administrator are not responsible for lost, interrupted or unavailable network server or other connection; miscommunications; failed phone or computer or telephone transmissions; technical failure; jumbled, scrambled or misdirected transmissions; late, lost, incomplete, delayed, or misdirected entries; or other error of any kind whether human, mechanical, or electronic. All entries submitted shall become the sole property of Sponsor and will not be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of
receipt by Sponsor or Administrator. Entries must provide all information requested; Incomplete, unreadable or unintelligible entries are void and disqualified. Sponsor and Administrator reserve the right to disqualify and reject any that Sponsor or Administrator determines to be in violation of any term contained in these Official Rules.
By submitting an entry, you warrant that you are authorized by your employer to submit an Assessment on its behalf. Additionally, by submitting an Assessment, you hereby grant to Sponsor and Administrator a royalty free, irrevocable, perpetual and worldwide license to use the contents of the Assessment.
6. Winner determination and verification
Winners will be selected on or about the Winner Notification Date as indicated on the Giveaway Table shown in Section 4 above for each corresponding Entry Period in a random drawing conducted by the Sponsor and Administrator from all eligible entries. Winners will be contacted via email by the Administrator, or designee. If the notification is returned as non-deliverable, or if winner is found not to be eligible or not in compliance with these Official Rules, the potential winner will be disqualified, the prize will be forfeited and an alternate winner will be selected in accordance with these Official Rules. Upon forfeiture, no compensation will be given. By taking part in this Giveaway, you agree to be bound by these rules and all decisions of the Sponsor and Administrator which are final and binding on all aspects of the Giveaway.
7. Prizes:
Twenty-four (24) prizes for the Event will consist of one (1) free ticket to Pax8’s Beyond 2024, Approximate Retail Value (“ARV”) of each Prize: $499.00.
TOTAL ARV ALL PRIZES: $11,976.00
The winner may assign the prize, in whole, to any other employee of Entrant’s employer. Prizes must be used for the registration costs for Beyond 2024.
If the Event(s) are cancelled, rescheduled, delayed or postponed, in whole or in part, Sponsor has no obligation to award any prizes. Sponsor reserves the right to substitute a prize or component thereof for one of equal or greater value if the designated prize should become unavailable for any reason. Odds of winning a prize depend on the number of eligible entries received during each respective Entry Period. Prizes are awarded “as is” without any warranties, guarantees or representation of any kind, expressed or implied (including without limitation, any implied warranty of merchantability or fitness for a particular purpose). Sponsor will not replace any prize that is lost, stolen, or used without permission. Limit of one (1) prize per person/per Event.
8. Release
By receipt of any prize, a winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, prize suppliers, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees, attorneys and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt, use, nonuse, or misuse of any prize.
9. Publicity
Except where prohibited by law, participation in the Giveaway constitutes each winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further notice, payment or consideration.
10. General conditions
If for any reason, (including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond reasonable control of Sponsor or Administrator and their parents, subsidiaries and affiliates, that corrupts or affects the administration, security, fairness, integrity, or proper conduct of each Giveaway), the Giveaway is not capable of being conducted as described in these Official Rules, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend this Giveaway, and may elect to hold a random drawing for any or all of the prizes offered herein from among all eligible entries received up to the date of discontinuance, or as otherwise deemed fair and appropriate by Sponsor to the extent reasonably possible and practical in light of the termination. Sponsor reserves the right in its sole discretion to disqualify any individual that it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.
11. Limitations of liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (2) technical failures of any kind, including, but not limited to equipment malfunctions and malfunctions, interruptions, or disconnections in cellular networks, phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use or misuse of any prize. No more than the stated number of prizes will be awarded. In the event that technical, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
12. Dispute resolution
You agree that any claim or dispute at law or equity that has arisen or may arise relating in any way to or arising out of the Giveaway or the Official Rules will be resolved in accordance with the provisions set forth in this Dispute Resolution Section. Please read this section carefully. It affects your rights and will have a substantial impact on how claims you and we have against each other are resolved.
You agree that whenever you have a disagreement with the Sponsor or Administrator arising out of, connected to, or in any way related to the Giveaway or Official Rules, you will send a written notice to the Sponsor (“Demand”). You agree that the requirements of this Dispute Resolution Section will apply even to disagreements that may have arisen before you accepted these Official Rules. You must send the Demand to: [email protected]. You agree that you will not take any legal action, including filing a lawsuit or demanding arbitration, until 20 business days after Sponsor’s receipt of a Demand. If the disagreement stated in the Demand is not resolved to your satisfaction within 10 business days after it is received, and you intend on taking legal action, you agree that you will file a demand for arbitration with the American Arbitration Association (the “Arbitrator”). This arbitration provision limits the ability of you, Administrator, and Sponsor to litigate claims in court and you, Administrator and Sponsor each agree to waive your respective rights to a jury trial or a state or federal judge. You agree that you will not file any lawsuit against Administrator or Sponsor in any state or federal court. You agree that if you do sue in state or federal court, and Administrator or Sponsor brings a successful motion to compel arbitration, you must pay all fees and costs incurred by Administrator and Sponsor in court, including reasonable attorney’s fees. For any such filing of a demand for arbitration, you must effect proper service under the rules of the Arbitrator and notice to the Notice Address may not be sufficient. If, for any reason, the American Arbitration Association is unable to conduct the arbitration, you may file your case with any national arbitration company. The Arbitrator shall apply the AAA Consumer-Related Disputes Supplementary Procedure effective September 15, 2005 (as may be amended) and as modified by the agreement to arbitrate in this Dispute Resolution section. You agree that the Arbitrator will have sole and exclusive jurisdiction over any dispute you have with Administrator or Sponsor. The Federal Arbitration Act allows for the enforcement of arbitration agreements and governs the interpretation and enforcement of the agreement to arbitrate.
You agree that you will not file a class action or collective action against Administrator or Sponsor, and that you will not participate in a class action or collective action against them. You agree that you will not join your claims to those of any other person. Notwithstanding any other provision in the Official Rules, if this class action waiver is invalidated, then the agreement to arbitrate is null and void, as though it were never entered into, and any arbitration dispute at that time will be dismissed without prejudice and may be refiled in a court. Under no circumstances do you, Administrator, or Sponsor agree to class or collective procedures in arbitration or the joinder of claims in arbitration. Administrator and Sponsor agree that we will submit all disputes with you to arbitration before the Arbitrator.
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrants, Administrator, and Sponsor in connection with the Giveaway, or any claim or dispute that has arisen or may arise between you, Administrator and Sponsor, shall be governed by, and construed in accordance with, the laws of the State of Colorado without giving effect to any choice of law or conflict of law rules.
13. Privacy policy
By participating in this Giveaway, all entrants authorize Sponsor to provide Administrator with their personal information. Any personal information collected in conjunction with this Giveaway will be subject to Sponsor’s privacy policy posted at https://www.pax8.com/en-us/privacy-policy/. In the event of a direct conflict between the privacy policy and these Official Rules, the privacy policy shall control and govern. By participating in this Giveaway, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy. Participation in the Giveaway constitutes Entrant’s understanding of, full and unconditional agreement to, and acceptance of these Official Rules.

15. Winners’ notification
Each winner will receive a personal email from Jennifer Bodell, CVP of Channel, on June 20th, 2023.
